Man to stand trial in fatal hit-and-run

A man charged with killing a woman in a hit-and-run crash near Wright has been bound over to District Court.

Raymond Gabriel Potts Jr. is charged with aggravated vehicular homicide. He was bound over Tuesday after Circuit Judge William S. Edwards determined that prosecutors had enough evidence against Potts to go to trial.

Potts, 44, is charged in the death of Raylene Sue Fischer, who was killed May 31 in a crash on Highway 387 near Wright. Prosecutors say the collision happened while Fischer was walking home from Hank’s Lounge.

She was found dead by the side of the road at about 2:20 a.m. The impact had knocked her shoes off, state Trooper Josh Underberg testified.

Potts was arrested that morning at a nearby RV park. He told officers he had been drinking at Hank’s Lounge. Potts said he remembered hitting something on the drive home but thought it was an antelope, Underberg said.

Investigators found a broken mirror at the crash scene with the word “Jeep” printed on it. Potts’ Jeep was badly damaged and his passenger-side mirror was missing, Underberg said.

Several hours after the crash, Potts’ blood-alcohol level was .12 percent, well above the legal limit. His listed address is in Harden, Mont., but he works in Campbell County in the energy industry, Nick Carter, Potts’ defense attorney, said after the hearing.

The case had languished in the lower court for seven months. The preliminary hearing, or evidentiary hearing, had been continued several times. Carter blamed the delay on his failed U.S. Senate campaign, which absorbed much of his time.

Potts, who is out on bond, faces up to 20 years in prison if convicted. His next court appearance hasn’t been set yet.
