RAPID CITY — A Rapid City evangelist is suing the South Dakota School of Mines & Technology, alleging that the school charged him $50 to speak on campus and limited him to an area inside a campus building.
Mark Gavin, of Black Hawk, filed the lawsuit in U.S. District Court. He is seeking a more prominent location on campus to preach. The lawsuit claims that the school treated religious speech as commercial speech when Gavin attempted to preach on campus in 2010 and 2011.
The Center for Religious Expression, a Memphis, Tenn., based nonprofit, filed the lawsuit on Gavin’s behalf.
An official for the school said the college could not comment on pending litigation.
